1. What this service is
ClearTM is a trademark monitoring tool. We scan public trademark filing data (via TMview, covering USPTO, EUIPO, WIPO, and participating offices) on a weekly basis and notify you of new filings matching the terms you choose to watch.
2. Not legal advice, not affiliated with any trademark office
ClearTM is not a law firm and does not provide legal advice. We are not affiliated with, endorsed by, or acting on behalf of the USPTO, EUIPO, WIPO, or any other trademark office. Nothing in this service should be relied on as a substitute for advice from a qualified trademark attorney.
3. No guarantee of completeness or timeliness
We make a good-faith effort to scan weekly and notify you of new matching filings, but the service depends on third-party data sources and infrastructure outside our control, and may experience delays, outages, or data gaps. ClearTM does not guarantee that you will be notified of every relevant filing, or notified within any particular time frame, including before an opposition deadline closes. You remain responsible for your own trademark monitoring and legal decisions. To the maximum extent permitted by law, ClearTM's liability for any claim arising from missed, delayed, or incomplete alerts is limited to the amount you paid for the service in the three months preceding the claim.
4. Billing
Subscriptions are billed monthly in advance via Stripe. You can cancel at any time through your account; cancellation takes effect at the end of the current billing period. No refunds for partial months, except as required by applicable law.
5. Acceptable use
You may not use ClearTM to harass, impersonate, or send unsolicited communications to trademark applicants based on data obtained through the service.
6. Termination
We may suspend or terminate accounts that violate these terms or that we reasonably believe are being used for abusive or unlawful purposes.
7. Changes to these terms
We may update these terms from time to time; material changes will be notified by email before taking effect.
8. Governing law
These terms are governed by the laws of India, and any dispute arising from them will be subject to the exclusive jurisdiction of the courts of India.
